A New Mexico judge has thrown out the child sex abuse indictment against actor Timothy Busfield over prosecutorial misconduct.

Judge Joseph Montano found the prosecutor “failed to act in a fair and impartial manner” before the grand jury.

Grand jurors had asked for more witnesses but were told it needed a subpoena and 36 hours’ notice.

They were not told a judge could shorten that time or that witnesses could testify voluntarily, the ruling said.

Busfield, 69, was indicted in February on four counts tied to alleged incidents on the set of The Cleaning Lady.

He has denied the allegations, and his attorney said he was “relieved and grateful” after the ruling.

His wife, actor Melissa Gilbert, posted a Shakespeare quote on Instagram marking the decision.

Prosecutors are evaluating their options and may still seek a new indictment from another grand jury.
